Shamala's verdict: Court should have resolved issues of law

By A.Vaithilingam

In my opinion, there is a tendency for judges who are Muslim to consider that they have a duty to protect their faith. There appears to be a pattern in this direction.

As I understand Islam, in all my years in religious organizations, judges must be unbiased.

This is similar to all other religious teachings. When Muslim judges and non Muslim judges give different judgments in matters involving Islamic tenets, it is confusing for lay people.

I hope all judges will decide all cases according to what they think is just, regardless of their views about their own faith.

When the civil High Court judge, in giving joint custody of the two children to husband and wife, ordered Shamala Sathiaseelan not to expose her two children to her own religion of Hinduism, the judge did not cite any civil law authority for such a decision.

When the government Islamic religious authority converted her own infant children to Islam without her consent, and the civil High Court refused to intervene telling her instead to submit to that religious department for assistance, it was the last straw for her.

If she committed contempt of court by leaving the country with her children, the above can be considered strong mitigating factors.

The husband who deserted her was being given special consideration because he was a Muslim.

Both the High Court and the government religious authorities did not give recognition to her equal rights as a mother and a woman.

She appealed to the Court of Appeal who referred the matter to the Federal Court. She hoped she would get justice. But the Federal Court has shut her out completely.

If she was in contempt of court, that offence must be considered separately.

It did not mean that she should be denied relief in the substantive matters she complained about.

Tanjung Gerakan Youth chief in hiding after Umno's Ahmad came out from suspension

Yesterday, we all got to know that the Umno Bukit Bendera division committee members tendered their resignations en-bloc in order to force a re-election of the said division which will see its formerly suspended division chief Ahmad Ismail coming back to helm the division once he lead.

According to Ahmad who told the press conference called by the division committee that in order for them to patch things up with Gerakan, its party president Tan Sri Dr Koh Tsu Koon must come out to "kow tow" and make a public apology.

Ahmad also mentioned should Dr Koh were to really come forward to "kow tow" and apologize, he will also need to review it with his division committee before he could formally accept them.

Just look at how arrogant this terrorist leader from Umno towards its BN component party member, Gerakan. And yet Gerakan was too scared to make any response to the Umno war mongering and hate messages.

Where is the Tanjung Gerakan Youth division chief H'ng Khoon Leng who often came up to criticize the DAP as a chauvinistic Chinese political party? Why is he so scared of Umno and dare not even put up a strong message to Ahmad?

H'ng is as coward as a mouse when come to dealing with Umno, the dominant party in the BN, but when it comes confronting the Pakatan Rakyat, he is quick to bash things up maybe because he felt comfortable bashing up politics of his own ethnic.

Well, this is all along Gerakan's cowardice anyway.

Ahmad "Kerbau" Ismail's return imminent, suicide bombers killed dozens of people

All 36 committee members of the Bukit Bendera Umno division have resigned in a move to force the re-election of the divisional committee, in particular to return Ahmad Ismail as its division chairperson after his less than 3 years suspension was lifted by the party supreme council.

Ahmad Ismail better known as Ahmad Kerbau was suspended for three years from the party membership before that for uttering racist remarks during the Permatang Pauh Parliamentary by-elections by calling the Malaysian Chinese community as "kaum pendatang" and "penduduk sementara". His suspension however, was lifted by the party leadership less than three years because of his "good behaviour".

During the press conference called by the Bukit Bendera Umno division yesterday, Ahmad also insisted that in order for him to patch up with Gerakan, its party president Tan Sri Dr Koh Tsu Koon must "kow tow" to him and apologize in public before he could forgive the later.

Meanwhile, two female muslim separatist suicide bombers had blown themselves up in the middle of the crowded and packed yesterday metro trains in central Moscow which killed about 37 people on board while about 60 over commuters were badly injured.

It is feared that more of those who were badly injured may die because the explosive and bombs exploded were filled with bolts and iron rods.

An Umno's anal called Perkasa

The Organization of Pribumi Greatness or better known as Perkasa which was formed by independent Pasir Mas member of parliament Ibrahim Ali often call for violent, hate and revengeful reactions against other Malaysians in the name of their "community's greatness".

What is so great about this Perkasa anyway? Spreading violent, hate and revengeful message around the country, organizing street demonstrations, protests, shouting and yielding here and there just to voice their hate, hate, hate and nothing else but hate.

If Perkasa hate the other Malaysians so much, we would advise them to go a more positive measure rather than to harm other people i.e. either you hit your own chest, bang your heads on the wall or you commit suicide to avoid all the challenges in this world that had always made you all frustrated.

Just look at Ibrahim's face, his reaction and moves (pic), it shows that he has deep hatred and wanted to avenge someone. He feel that he and his guys were being marginalized for decades and that is why he is standing up to start a war to fight with his band of Perkasa armies.

What is Perkasa anyway? It is actually a sub-contract organization who is now playing the role of upholding the defense on "Ketuanan" or Supremacist on behalf of Umno. Umno sub-contracted this role to Perkasa in order not to offend their fellow BN component parties such as MCA, MIC, Gerakan, PPP, SUPP, PBS, PRS, Upko, etc, etc.

By sub-contracting the more radical racist tone and its role to Perkasa, Umno hope to escape from being scrutinized by its fellow component parties in the BN which Umno is a dominant part of it. Perkasa was also sub-contracted to bring the Malay community back into Umno's fold by labelling political parties other than Umno as anti-Malay, destroying Malay rights, marginalizing Malays and traitors to the Malay's course.

Anyone who did not follow the Perkasa's course are just simply being labelled as traitors or in other words "penderhaka" and anti-constitution.

And while Perkasa is sub-contracted with the radical agendas, Umno makes it clean by doing its 1Malaysia (traps) as usual in order to "win back" the heart of the non-Malay communities. A very well-planned conspiracy in doing.

To trap the voters back into their machinery and eliminate them once and for all, while Perkasa is just an Umno's dirty anal, doing all the dirtiest job for the later.

Intended cover up but now exposed

Initially there was an intention to cover up the inspector-general of police (IGP) Tan Sri Musa Hasan plan to resign from his post. Musa had in fact tendered his resignation to the home affairs minister Datuk Seri Hishammuddin Hussein but the minister rejected it and instead requested him to serve till his contract expires on September.

As such, what China Press had earlier reported based on the leak from Bukit Aman itself was in fact true. Musa was asked to retract his resignation and deny in public that he had resigned which resulted to China Press being made a scapegoat for alleged "misreporting".

Is Hishammuddin doing this for the sake of saving his own face by using Musa as a shield? A very well-planned conspiracy being carried out in such a way.

Indeed a very dirty well-planned conspiracy.

Attempt to terrorize Penang failed

Attempts by Umno-link NGOs, Penang Malay Chamber of Commerce, Peninsular Malaysia Malay Students Confederation (GPMS) and a radical Malay front called Perkasa to distabilize Penang and its state government failed as the Penang people had choose not to be influenced by these groups who were out there to demonstrate their terror and hate in order to scare the people into submission.

Scores of supporters and members of these three groups had earlier yesterday gathered at the Penang state government administrative centre in Komtar to demonstrate against what they claimed "racial oppression" by the state leadership and got an effigy of the chief minister burned in public.

Besides, the supporters and members of these groups also shouted and chanted racist and hate slogans in order to voice their dissent against the Pakatan state government.

What kind of dissent are they talking about? Pro-government newspapers also painted an ugly side of the state government and taking side at the radical Malay NGOs who are all Umno-link saying that the Penang leaders had not done enough and oppressing the "Malays".

Actually they are not demonstrating against oppression. They are actually promoting hate, violence and terrorism simply because they had lost their influence. They wanted to drum up racial sentiments and organize a revolt in order to regain their support from only their race.

These NGOs are only experts in hate, hate, hate and nothing else but hate. They are doomed!

Hishamuddin suffering from brain damage

The home minister and Umno vice president Datuk Seri Hishamuddin Hussein might be suffering from a severe brain damage and he must seek help to cure his sickness.

Why did we say that? Because he said the bloggers are unethical and that means Utusan Malaysia is doing a great job! This shows that he didn't know what he himself is talking about. He is out of his mind.

Right now, as everyone is aware, Utusan Malaysia is actively promoting hatred, racial divide and trying to create political unrest in our nation by putting up racist articles in their newspaper. First they wanted 13 May to repeat, then they insulted the Chinese and now they said the Indians are rough guys.

And just because Utusan Malaysia is Umno's wholly-owned, the home minister supported their move and condemned the bloggers instead because the truth were being widely reported in public.

Until now, no action was taken against Utusan Malaysia for its racist and hate messages which were published regularly. Whereas when the bloggers are trying to report and spread the truth and to correct the inaccurate, they were harrassed by the police special branch and threatened with imprisonment.

This is undemocratic and dictatorial. Can we trust this federal government again?

What belittling Islam?

We heard that a police report has been made by the Malay Unity Action Force president Osman Abu Bakar who is also an Umno member, against Perak DAP Secretary Nga Kor Ming for belittling Islam in a ceramah at Changkat Jering, Perak.

We understood that Nga merely referred to some words in Surah Al-A’raf during his political ceramah. Nga referred to the Quranic verse as a guidance and example to inform the people on Pakatan Rakyat’s program for the people. What is wrong with that?

Let’s say if he were to recite the verse inaccurately, it does not mean he had insulted Islam or belittled Islam. He tried his best to recite the verse and he did not try his best to insult Islam. What Osman Abu Bakar claimed on his police report was definitely nonsense and he has being a radical racist narrow minded guy who only wanted to serve the interest of Umno and his own.

Osman is trying to politicize the Quranic verse in order to provoke racial tension and if this happens, Umno will have the opportunity to call in the security force to arrest these guy and that guy, and locking them up into ISA for “national security” reasons.

Even the Mursyidul Am of PAS and Kelantan Mentri Besar Datuk Nik Abdul Aziz Nik Mat had confirmed that there is nothing wrong if a non-Muslim were to recite a surah from the Quran, provided that he did not insult or criticize it. Did Nga insult or criticize Islam? No he didn’t at all. It was Osman who had in fact insulted Islam by politicizing it and brought the matter to the police for no reason.

What we could see here is Osman is trying to play with the religion in order to provoke racial and political tensions. This is clearly an Umno’s intention.

We still remember that an Umno leader from Penang had also belittled Buddhism by saying that Buddhism is a religion with a lower standing in this country. He is Shabudin Yahya, the Umno state assemblyman for Permatang Berangan. He said “this is something scary because Islam is seen as having a same standing as Buddhism which was founded by a man named Gautama Buddha”. This is clearly insulting Buddhism, because what he said really belittled Buddhism.

So, because of Umno supremacy, its party leader had the right to insult and belittle anyone they wish to but when someone tried to recite a Quranic verse because he made it as his guidance even if he is not a Muslim, Umno will definitely say this guy is insulting Islam. Is this fair?

Umno had nothng at all. They just like to instill hate, hate and nothing but hate.

Umno has keris, why not the 'clenched fist'?

Parti Sosialis Malaysia (PSM), which recently won a decade-long battle for recognition, faces a new hurdle after the election commission (EC) rejected its "clenched fist" symbol as too violent.

What sort of people in EC who made such an uncivilised decision? The "clenched first" being too violent. To us, the Umno's "keris" is the most violent. It symbolised hatred, kill, violent, threat and terrorism.

The EC decision on not accepting PSM's logo for the use in general election is clearly a political motivated one. The registrar of societies had already approved the registration of PSM, so is EC trying to sabotage PSM's existence and its rights "on behalf" of Barisan Nasional?

This action also clearly symbolised BN-Umno's ketuanan to curb human rights, freedom of speech and freedom of association.

Umno's Hisham bars Pakatan leaders from schools

According to Malaysiakini today, a list issued by Education Minister Hishammuddin Hussein to all schools in Selangor allowed only 73 leaders from BN to attend events in the schools in the state.

Looks like Hishammuddin and Umno is very revengeful towards the Selangor Pakatan Rakyat State Government and did not want the Pakatan officials to attend the schools' functions in the state.

This move is clearly a sabotage act by Umno and its BN lackeys in order to create instability in Selangor by instilling hatred and anger, at the same time provoke other sentiments which is deemed harmful to the state government and its people.

Karpal Singh, victim of Umno youth’s violent and “ketuanan” campaigns

In this “bullets” episode, Bukit Gelugor MP Karpal Singh being a wheelchair-bound man with disability to walk and move about freely but yet, he still serves his people and nation well despite all those short comes.

And yet today, Karpal has been a victim of Umno youth’s violent campaign just because he wanted to end their immunities that they are enjoying and bring all those who were behind the “bullets” episode to justice.

Why did the Umno youth members stormed the parliament attempting to assault Karpal? The Umno youth are guilty conscious and wanted to cover-up the “bullets” episode by diverting the attention to their grievance,at the same time, trying to ensure their immunities are not violated.

The Umno youth members felt that their guilt has been overblown by those who wanted justice into such a criminal act. In fact sending the bullets to an innocent person’s house was already a criminal act. We all know who had demonstrated in front of Karpal residence the other day and we also know who had shown the violent acts and issue threats in front of Karpal’s residence the other day.

The Umno youth members felt their guilt because of Karpal’s attempt to expose them and to end their immunities. When the Umno youth members attacked Karpal at the parliament compound, the security personnel and the police who are directly under the home ministry managed by an Umno supreme council did not act against those attackers, because they were instructed not to do so, just because those attackers were also Umno youth members.

Just imagine if those attackers were not from Umno and they were from other political parties, they are sure to be caught, beaten-up and thrown into the nearby police lock-ups immediately. As those attackers were Umno youth members, the home minister did not want the authorities to act against them. This is what Umno’s “ketuanan” means.

Umno’s “ketuanan” also guarantees its members are immune, above the law, above the sultanate, above god and above the federal constitution. That means, like it has been shown in the past few years, Umno reserves the right to organize violence, promoting hatred, organize their so-called band of militias and wage war onto the people and the entire nation if anyone found to have spoken against them, vote against them, criticizing them and so on. The act of criticizing Umno and exposing their wrongdoings are all seen as committing treason against the country, against the sultanate and against the constitution.

But with Umno’s “ketuanan” they are exempted from all such labels which they put on other people, in 1993 they could undermine the sultanate and withdraw their powers and immunities without much problems, during the past years, they issued threats of wanting to burn down the Selangor Chinese Town Hall and wanted to organize violence, promoting hatred, bloodshed, to burn down Kuala Lumpur and their numerous threats to repeat the May 13 incident if they were to lose in the general elections again and so on, hoping to scare the people into continuing to vote them so that such violence will not occurred.

Because of Umno’s “ketuanan” they are of cause also exempted from the law and constitution. They act in such a way because they said that they are immune, above the law, above the sultanate, above god and above the federal constitution.

Why did they hate us so much?

Almost everyday, the name and word Umno has been regularly mentioned in media and other mainstream communication channels. Well, it does not mean Umno is popular. It is because Umno had became too irrelevant until they desperately needed the media and press to assist them in furthering their outdated political agendas so that the people will hear, see and “understand” their policies.

After the 8 March general elections last year, these Umno leaders are frustrated and shocked with their losses and defeats after 50 years of their firm grip in power. They where shock in disbelieve that five states had eventually fell into Pakatan Rakyat’s hands.

When they were defeated, these Umno leaders put the blame on Pakatan Rakyat for their extensive campaigns, the bloggers, the younger generations and our people. These Umno leaders blamed us because of their defeat they had also lost much of their profit making channels in our nation. These Umno leaders blamed us because their positions in the party, government and businesses are not at stake.

And that is why they hate us so much, because we did not vote for them but choose Pakatan Rakyat instead. The hate us so much because they had lost their two-thirds majority in the parliament and their powers has been drastically reduced to a mere balance only to govern.

They denied that they themselves were the contributors to their own defeat. They said that their defeat were because the people sabotaged them, disowned them and disbelieve in them. And that are the only reasons that the Umno leaders had till today. They deny every single fault if they were to be from their party. They are still in a very denial mode. These Umno leaders are hiding their heads under the sand just like the ostrich.

That is why these Umno leaders are resorting to various undemocratic, uncivilized, dictatorial and unjust means to ensure that they remain in power. They are now ensuring that all federal government security organs are fully utilized in order to curb the rising influence of the Pakatan Rakyat and the people’s dissatisfaction. These Umno leaders are now working very hard to put the Internal Security Act, Sedition Act, Official Secrets Act, Printing Press Act, etc into full use so that the people would not dare to speak out and expose their misdeeds in public.

They wanted to ensure that the people listen to them and their instructions carefully and obediently without any further questions. If condition warrants they may push their policies into a harsher implementation and ensure tougher enforcements are in place to proceed with their plans.

There they goes, Perak Umno launched a coup d’etat to topple the legitimate Perak state government and installed its leaders and members in the rebel state government after putting their pressure on the Perak Sultanate to recognize their power seizure. Apart from Perak, they are also planning to hatch similar plots in Selangor and Kedah but had put their plans on hold after their attempts were exposed.

Then, when certain people wanted to come forward to report their misdeeds to the relevant authorities, these Umno leaders claimed that they were liars and promised to avenge such reports by threatening those who had reported against them with imprisonment and security detentions.

Besides, their leaders in the youth wing especially, are also getting more violent and racist, attempting, warning and threatening the population with murders, violence, war, supremacy, “bullets” and so on. The Umno youth wing had became more like a Nazi storm trooper where they could attack and condemn any meetings or gatherings which speak against them, criticizing them or uprooting their misdeeds.

These has become of Umno who will turn our nation into a Nazi police state one day. Will we be able to rid off Umno before they could ever rid our nation off the map? We better make our decisions fast.

We must therefore insist a final solution on the Umno’s question fast! Let us all show them that this nation belongs to us and they do not own this nation as they claimed.

We want to preserve the peace, harmony and unity in our nation which we have been maintaining for the past fifty one years. We must preserve these harmonious entities of ours for our generations to come.

Why these fanatics are still promoting hatred and disunity?

Just look at what these fanatics are doing and putting these hate banners in the streets. What are they trying to prove actually? Why did they hate other people so much and resorted to such action and threats onto the other peace loving communities.

To those hate mongers, we are all here to live peacefully amongst multi-racial, multi religious and multi cultural society. We all truly love peace, harmony, friendship and unity but there are some fanatics who are supported by a BN component party are out there to create more and more hate and nothing but hate onto others and possible to provoke anger of another race.

What can they gain by promoting hatred among our communities actually? This has to be stopped at all cost. But the police force and other authorities are not doing enough to prevent such racist fanatics from continuing all these. Is it because these hate mongers are members of a BN dominant component party?
And also, why MCA, Gerakan, MIC, IPF and PPP are keeping quiet on these? Are they too afraid to voice their discontent on their master component party in the BN or what?

Can we see action against these people who promote terror as soon as possible? We want to have a peaceful and harmonious living. We want Unity.
